Regulations of the Online Store net-parts.pl
I. General Provisions
- These Regulations define the general conditions, rules of using the Online Store, and the method of providing services electronically and sales conducted through the Online Store net-parts.pl by NETPARTS Marcin Pawlik, entered into the CEIDG under the NIP number: 9950111279. The store is operated at the address ul. Polna 5, 62-062 Strykowo.

- These Regulations are continuously available on the website http://net-parts.pl, in a way that allows Users to acquire, reproduce, and record its content by printing or saving on a medium at any time.
II. Definitions
The terms used in the Regulations mean:
- Working days – these are days from Monday to Friday, excluding statutory holidays;
- Consumer – a natural person making a legal transaction with an entrepreneur not directly related to their business or professional activity;
- Entrepreneur - a natural person, a legal person, and an organizational unit that is not a legal person, to which special provisions grant legal capacity, conducting business or professional activity in their own name;
- User – means a Consumer or Entrepreneur using the Services provided by the Seller via the Online Store or making a purchase of Goods offered in the Store;
- Civil Code – the Act of April 23, 1964 (Journal of Laws of 2014, item 121, as amended);
- Account – a part of the Online Store assigned to a given User, through which the User can perform specific actions within the Online Store;
- Personal collection point - ul. Polna 5, 62-062 Strykowo;
- Carrier – an entity or person delivering the Goods ordered by the User;
- Regulations – this document;
- Registration – a one-time activity consisting of creating an Account by the User, made using the registration form provided by the Seller on the Online Store website;
- Online Store (Store) – web pages through which the User can, in particular, place Orders;
- Seller - Marcin Pawlik conducting business activity under the company Netparts Marcin Pawlik in Stryków entered into the Central Registration and Information on Business conducted by the Minister of Economy, at the address NETPARTS Marcin Pawlik, ul. Polna 5, 62-062 Strykowo, NIP: 9950111279, REGON: 301506784;
- Goods – products presented in the Online Store, whose description is available for each of the presented products;
- Sales Agreement – a sales agreement of Goods within the meaning of the Civil Code, concluded between the Seller and the User;
- Services – services provided by the Seller to Users electronically within the meaning of the provisions of the Act of July 18, 2002, on providing services electronically (Journal of Laws of 2013, item 1422, as amended);
- Act on Consumer Rights – the Act of May 30, 2014, on consumer rights (Journal of Laws 2014, No. 827);
- Act on Providing Services Electronically – the Act of July 18, 2002, on providing services electronically (Journal of Laws of 2013, item 1422, as amended);
- Order – a declaration of intent of the User, aiming directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.
III. Rules for Using the Online Store
- Using the Online Store is possible provided that the teleinformatic system used by the User meets the following minimum technical requirements:
- a computer or mobile device with Internet access,
- access to electronic mail,
- Internet Explorer version 11 or newer, Firefox version 28.0 or newer, Chrome version 32 or newer, Opera version 12.17 or newer, Safari version 8.0. or newer,
- enabling Cookies and Javascript in the web browser.
- Using the Online Store means any User's activity that leads to them becoming acquainted with the contents included in the Store.
- The User is obliged in particular to:
- not deliver and not transmit content prohibited by law, e.g., content promoting violence, defamatory or violating personal rights and other rights of third parties,
- use the Online Store in a way that does not disrupt its functioning,
- especially through the use of specific software or devices,
- not undertake actions such as: sending or posting unsolicited commercial information (spam) within the Online Store,
- use the Online Store in a way that is not burdensome for other Users and the Seller,
- use all content posted within the Online Store only for personal use,
- use the Online Store in a manner consistent with the laws in force in the territory of the Republic of Poland, the provisions of the Regulations, and the general principles of using the Internet.
IV. Services
- The Seller enables the use of free Services through the Online Store, consisting of:
- browsing information posted in the Online Store,
- running an Account in the Online Store,
- providing an interactive form enabling Users to place an Order in the Store,
- providing an interactive form enabling Users to contact the Seller.
- The Services indicated in point 1 are provided by the Seller 24 hours a day, 7 days a week.
- The Agreement:
- on providing the service of browsing information posted in the Store is concluded for a fixed period and is terminated when the User closes the Store's website,
- on providing the service of running an Account in the Store is concluded for an indefinite period and is terminated when the User sends a request to delete the Account or uses the "Delete Account" button,
- on providing the service of making available an interactive form enabling Users to place an Order in the Store is concluded for a fixed period and is terminated upon placing the Order,
- on providing the service of making available an interactive form enabling Users to contact the Seller is concluded for a fixed period and is terminated upon the Seller's response.
- The service of running an Account in the Online Store is available after Registration. Registration takes place by filling in and accepting the registration form, made available on one of the Store's pages.
- A condition of Registration is agreeing to the content of the Regulations and providing personal data marked as mandatory.
- In the event of a breach of the provisions of these Regulations by the User, the Seller, after a prior ineffective call to cease or remove the violations with an appropriate deadline, may terminate the agreement for the provision of Services with a 14-day notice period.
- The Store has the right to organize occasional contests and promotions, the conditions of which will be provided each time on the Store's web pages.
- Promotions in the Store are not subject to combination unless the Regulations of a given promotion state otherwise.
- Promotions and contests referred to in points 7 and 8 above are directed exclusively to Consumers unless the content of a given promotion states otherwise.
V. Procedure for Concluding the Agreement

Information about the Goods provided on the web pages of the Store, in particular their descriptions, technical and usage parameters, and prices, constitute an invitation to conclude a contract, as understood by Article 71 of the Civil Code.

All Goods available in the Store are brand new, free from physical and legal defects, and have been legally introduced to the Polish market.

A condition for placing an Order is having an active email account.

A condition for placing an Order by phone is having an active email account and a telephone line.

A condition for placing an Order via email is having an active email account.

Orders can be placed via the Order form or email 24 hours a day, 7 days a week, and Orders placed by phone can be placed on Business Days from 8 am to 5 pm.

For Users who are Consumers, the procedure for concluding the Agreement is as follows:
7.1. An Order can be placed by: - Using the Consumer's personal data obtained as a result of prior registration in the Store (purchase via Account), - Filling out the electronic Order form, including the Consumer's data necessary for the execution of the Order, in particular: name and surname, place of residence, and email address, - Placing an Order orally by phone using the Store's phone number provided by the Seller on the Store's website, the Order content should include the Consumer's data necessary for the execution of the Order, in particular: name and surname, place of residence, and email address; name of the Goods and their quantity, form of delivery, and method of payment, - Placing an Order by sending an email to the email address provided by the Seller on the Store's website, the Order content should include the Consumer's data necessary for the execution of the Order, in particular: name and surname, place of residence, and email address; name of the Goods and their quantity, form of delivery, and method of payment.
7.2. To conclude a Sales Agreement via the Online Store and the provided Order form, it is necessary to select Goods, undertaking subsequent technical actions based on messages and information displayed to the Consumer.
7.3. The Consumer's selection of ordered Goods is made by adding them to the cart.
7.4. After providing all the necessary data by the Consumer using the Online Store, a clear and visible summary of the placed Order will be displayed. The Order summary will include information regarding: - Description of the Order item, - Unit and total price of the ordered Goods or services including taxes, including delivery costs and additional costs (if any), - Method of contact with the Seller, - Chosen method and date of payment, - Chosen method of delivery, - Delivery time, - Consumer's contact details.
7.5. To send an Order, it is necessary to accept the Terms and Conditions and confirm acquaintance with the "Instruction on withdrawal from the contract", provide personal data marked as mandatory, and press the "Buy and pay" button.
7.6. Sending an Order by the Consumer constitutes an offer to the Seller to conclude a sales agreement for the Goods that are the subject of the Order.
7.7. After placing the Order, the Consumer receives an email confirming the receipt of the Order (along with an individual Order number), containing a final confirmation of all essential elements of the Order.
7.8. The Seller then sends a confirmation of the Order placement to the Consumer's email address provided, which constitutes the Seller's statement of acceptance of the offer referred to in subsection 7.6 above, and upon its receipt by the Consumer, a Sales Agreement is concluded.
7.9. Consumers placing Orders in the Store by phone or by sending an email for the purpose of placing an Order should: - Provide by phone or in the text of the email addressed to the Seller the name of the Goods among those on the Store's website and their quantity, - Indicate the method of delivery and form of payment from among the methods of delivery and payment listed on the Store's website, - Provide data necessary for the execution of the Order, in particular: name and surname, place of residence, and email address.
7.10. Information about the total value of the Order is provided each time by the Seller orally after completing the entire Order and making a choice by the Consumer of the form of delivery and specifying the form of payment, or by informing via email along with the information that the Consumer's conclusion of a Sales Agreement entails an obligation to pay for the ordered Goods. The Seller each time after placing the Order via phone or email sends the Consumer a confirmation of the conditions of the placed Order, which will include information regarding: - Description of the Order item, - Unit and total price of the ordered Goods or services including taxes, including delivery costs and additional costs (if any), - Method of contact with the Seller, - Chosen method and date of payment, - Chosen method of delivery, - Delivery time, - Consumer's contact details, - Terms and Conditions, - Instruction on the right to withdraw from the contract along with its template.
7.11. The Agreement is concluded at the moment of sending an email by the Consumer (in response to the confirmation of the Order conditions sent by the Seller) to the Seller's email address, in which the Consumer: accepts the content of the sent Order and agrees to its execution, and accepts the Terms and Conditions and confirms acquaintance with the instruction on withdrawal from the Agreement.
7.12. After concluding the Sales Agreement, the Seller confirms its conditions to the Consumer, sending them to the Consumer's email address or in writing to the address provided by the Consumer.
7.13. The Sales Agreement is concluded in Polish.
7.14. The content of the concluded sales agreement is in accordance with the Terms and Conditions.

For Users who are Entrepreneurs, the procedure for concluding the Agreement is as follows:
8.1. An Order can be placed by: - Using the Entrepreneur's data obtained as a result of prior registration in the Store (purchase via Account), - Filling out the electronic Order form, including the Entrepreneur's data necessary for the execution of the Order, in particular: company name, headquarters or in the case of natural persons conducting business or professional activities on their own behalf, place of residence and email address, - Placing an Order orally by phone using the Store's phone number provided by the Seller on the Store's website, the Order content should include the Entrepreneur's data necessary for the execution of the Order, in particular: company name, headquarters or in the case of natural persons conducting business or professional activities on their own behalf, place of residence and email address, name of the Goods and their quantity, form and address of delivery, and method of payment, - Placing an Order by sending an email to the email address provided by the Seller on the Store's website, the Order content should include the Entrepreneur's data necessary for the execution of the Order, in particular: company name, headquarters or in the case of natural persons conducting business or professional activities on their own behalf, place of residence and email address, name of the Goods and their quantity, form of delivery, and method of payment.
8.2. Actions aimed at concluding the Agreement, in particular placing an Order, can only be performed by persons duly authorized to act on behalf of the Entrepreneur.
8.3. To conclude a Sales Agreement via the Online Store and the provided Order form, it is necessary to select Goods, undertaking subsequent technical actions based on messages and information displayed to the Entrepreneur.
8.4. The Entrepreneur's selection of ordered Goods is made by adding them to the cart.
8.5. After providing all the necessary data by the Entrepreneur using the Online Store, a clear and visible summary of the placed Order will be displayed. The Order summary will include information regarding: - Description of the Order item, - Unit and total price of the ordered products or services including taxes, including delivery costs and additional costs (if any), - Method of contact with the Seller, - Chosen method and date of payment, - Chosen method of delivery, - Delivery time, - Entrepreneur's contact details, - Invoice data.
8.6. To send an Order, it is necessary to accept the Terms and Conditions, provide personal data marked as mandatory, and press the "Buy and pay" button. The instruction on withdrawal from the contract is addressed exclusively to Consumers.
8.7. Sending an Order by the Entrepreneur constitutes an offer to the Seller to conclude a sales agreement for the Goods that are the subject of the Order.
8.8. After placing the Order, the Entrepreneur receives an email confirming the receipt of the Order (along with an individual Order number), containing a final confirmation of all essential elements of the Order.
8.9. The Seller then sends a confirmation of the Order placement to the Entrepreneur's email address provided, which constitutes the Seller's statement of acceptance of the offer referred to in subsection 8.7. above.
8.10. Entrepreneurs placing Orders in the Store by phone or by sending an email for the purpose of placing an Order should: - Provide by phone or in the text of the email addressed to the Seller the name of the Goods among those on the Store's website and their quantity, - Indicate the method of delivery and form of payment from among the methods of delivery and payment listed on the Store's website, - Provide data necessary for the execution of the Order, in particular: company
VI. Delivery
- The delivery of Goods is limited to the territory of the Republic of Poland and is carried out to the address indicated by the User when placing the Order.
- The User may choose the following forms of delivery for the ordered Goods:
- via Carrier,
- Seller's own transport,
- personal collection at the Seller's personal collection point.
- In the case of delivery of Goods outside the borders of the Republic of Poland, the form of delivery of Goods will be individually agreed with the User each time.
- Additionally, the delivery costs will be indicated at the time of placing the Order.
- For Orders over 249 PLN gross, when the weight of the Order is up to 30 kg, the User does not bear the delivery costs with prepayment. If the weight of the Order described above is over 30 kg, the User only bears the delivery costs of the Order resulting from exceeding the indicated weight.
- In the case of Orders placed by Entrepreneurs, despite free delivery under the conditions indicated in point 5 above, in the case of non-collection of the shipment from the Carrier, Entrepreneurs bear the costs of re-delivering the Goods.
- The Seller informs the User on the website of the Store in the description of the Goods about the number of Working Days needed to fulfill the Order and its delivery, subject to point 9 below.
- The delivery time and order fulfillment are counted in Working Days according to point VII subpoint 2.
- The above terms do not apply to the fulfillment of Orders for Goods produced or imported on a special order by the Entrepreneur, as well as orders for Goods that the Seller does not have in stock at the time of placing the Order by the Entrepreneur. The Seller will notify the Entrepreneur of such circumstances. The parties will individually agree on the time and place of collection or delivery.
- In the event of difficulties with fulfilling the Order placed by the Entrepreneur, the delivery time may be extended, for which the Seller is not responsible.
- The Seller, in the case of Orders placed by Consumers, delivers the Goods with a receipt, and in the case of Orders placed by Entrepreneurs, with a VAT invoice.
- The costs of issuing and collecting Goods that are the subject of an Order placed by an Entrepreneur are borne by the Entrepreneur.
- From the moment of handing over the Goods that are the subject of an Order placed by an Entrepreneur to the Carrier or directly to the Entrepreneur (in the case of personal collection), the benefits and burdens associated with the thing and the risk of accidental loss or damage to the thing pass to the Entrepreneur.
- The Entrepreneur, upon receiving the shipment, is obliged to check its condition. In case of finding damages or other reservations during the receipt of the Goods by the Entrepreneur, a protocol of reservations should be drawn up in the presence of the Carrier, precisely specifying the quantity and type of Goods and their damages according to the procedure applicable to the given Carrier.
- In the case of Orders placed by Entrepreneurs, the Seller is not responsible for the actions of the Carrier.
- The Seller is not liable for damages resulting from incorrect data provided by the Entrepreneur during the placement of the Order, caused by incorrect provision of contact details or the collection address.
- It is assumed that the person receiving the Goods on behalf of the Entrepreneur is authorized by him to receive the delivery and to sign on his behalf on the delivery document, as well as to perform other related activities.
- In the case of a one-time failure by the Entrepreneur to collect the Ordered Goods, if they were delivered via the Carrier, or failure to collect them within 7 days of receiving notification of the readiness of the Goods for collection at the Seller's personal collection point, the Seller has the right to immediately terminate the Agreement concluded with the Entrepreneur. In addition, the Entrepreneur is obliged to pay the costs incurred by the Seller due to the non-collection of the Goods referred to in this subpoint.
- The Seller is responsible for physical and legal defects of the goods according to the provisions of the Civil Code, in particular articles 556 and 5561 -5565 of the Civil Code. The warranty for physical and legal defects is excluded for Entrepreneurs.
VII. Prices and Payment Methods
- The prices of Goods are given in Polish zlotys and include all components, including VAT, customs duties, and other charges.
- The User may choose the following payment methods:
- bank transfer to the Seller's bank account (in this case, the execution of the Order will start after the Seller sends the User a confirmation of acceptance of the Order, and the shipment will be made immediately after the funds are credited to the Seller's bank account and the Order is completed);
- cash on personal collection - payment at the Seller's personal collection point (in this case, the execution of the Order will be made immediately after the Seller sends the User a confirmation of acceptance of the Order, and the Goods will be issued at the Seller's personal collection point);
- cash on delivery, payment to the supplier when making the delivery (in this case, the execution of the Order and its shipment will start after the Seller sends the User a confirmation of acceptance of the Order and the Order is completed);
- electronic payment or payment by credit card: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro. The entity providing online payment service for card payments is Autopay (in this case, the execution of the Order will start after the Seller sends the User a confirmation of acceptance of the Order and after the Seller receives information from the settlement agent's system about the User's payment, and the shipment will be made immediately after the Order is completed).
- The Seller informs the User on the website of the Store in the description of the Goods about the deadline by which he is obliged to make payment for the Order. In the case of non-payment by the Consumer within the deadline mentioned in the previous sentence, the Seller, after a previous unsuccessful call to stop or remove violations with an appropriate deadline, may withdraw from the sales agreement based on Article 491 of the Civil Code. In case of non-payment by the Entrepreneur within the deadline mentioned in the first sentence of this subpoint, the Seller may immediately terminate the Agreement with the Entrepreneur, and the Seller charges statutory interest for each day of delay in payment for the Order by the Entrepreneur.
- In relation to Entrepreneurs, the Seller may use net prices.
VIII. Right to Withdraw from the Contract
- The right to withdraw from the Agreement is available exclusively to Consumers.
- The Consumer may withdraw from the contract without giving any reason by submitting an appropriate statement within 14 days. To keep this deadline, it is sufficient to send the statement before its expiry.
- The Consumer may formulate the statement independently or use the template statement of withdrawal from the contract, which is Annex No. 1 to the Regulations.
- The 14-day period is counted from the day on which the Goods were delivered or in the case of a service agreement from the day of its conclusion.
- The Seller, upon receiving the Consumer's statement of withdrawal from the contract, will send a confirmation of receipt of the statement of withdrawal from the contract to the Consumer's email address.
- The right to withdraw from the contract by the Consumer is excluded in the case of:
- the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the start of the service that after the Seller's fulfillment of the service, he will lose the right to withdraw from the contract;
- a contract in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control, and which may occur before the deadline for withdrawing from the contract;
- a contract in which the subject of the service is a non-prefabricated Good, produced according to the consumer's specification or serving to satisfy his individualized needs;
- a contract in which the subject of the service is a Good subject to rapid deterioration or having a short shelf life;
- a contract in which the subject of the service is a Good delivered in a sealed package, which cannot be returned after opening the package for health protection or hygiene reasons if the package has been opened after delivery;
- a contract in which the subject of the service are Goods which, due to their nature, are inseparably connected with other things after delivery;
- a contract in which the subject of the service are alcoholic beverages, the price of which was agreed upon at the conclusion of the Sales Agreement, and whose delivery can only take place after 30 days and whose value depends on fluctuations in the market over which the Seller has no control;
- a contract in which the Consumer explicitly requested the Seller to come to him to make urgent repairs or maintenance; if the Seller provides additional services other than those requested by the Consumer, or delivers Goods other than spare parts necessary to perform the repair or maintenance, the Consumer has the right to withdraw from the contract regarding additional services or Goods;
- a contract in which the subject of the service are sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery; supplying newspapers, periodicals, or magazines, except for a subscription agreement;
- a contract concluded through a public auction;
- the provision of services in the field of accommodation, other than for residential purposes, transport of goods, car rental, gastronomy, services related to leisure, entertainment, sports, or cultural events, if the contract specifies a day or period of service provision;
- delivering digital content that is not stored on a tangible medium if the performance of the service began with the express consent of the Consumer before the deadline for withdrawing from the contract and after informing him by the Seller about the loss of the right to withdraw from the contract
IX. Warranty Claims Regarding Goods
- The Seller is liable to the Consumer under warranty for defects according to the principles set out in Articles 556 – 576 of the Civil Code.
- Complaints resulting from the violation of the Consumer's rights legally guaranteed or based on these Regulations should be directed to the address NETPARTS Marcin Pawlik, ul. Polna 5, 62-062 Strykowo, biuro@net-parts.pl.
- To consider the complaint, the Consumer should send or deliver the complained Goods, if possible attaching proof of purchase. The Goods should be delivered or sent to the address indicated in point 2 above.
- The Seller undertakes to consider each complaint within 14 days.
- In case of deficiencies in the complaint, the Seller will call the Consumer to supplement it as necessary immediately, but no later than 7 days from the date the Consumer received the request. The Seller refunds the Consumer the shipping costs.
- Warranty for physical and legal defects is excluded for Entrepreneurs.
X. Complaints Regarding Electronic Service Provision
- Users may submit complaints to the Seller regarding the functioning of the Store and the use of Services. Complaints can be submitted in writing to the address: NETPARTS Marcin Pawlik, ul. Polna 5, 62-062 Strykowo, via email: biuro@net-parts.pl, or using the contact form.
- In the complaint, the User should provide their name and surname, correspondence address, type, and description of the problem.
- The Seller undertakes to consider each complaint within 14 days, and if this is not possible, to inform the User during this period when the complaint will be considered. In case of deficiencies in the complaint, the Seller will call the User to supplement it as necessary within 7 days from the date the User received the request.
XI. Guarantees
- Goods may have a manufacturer's, Seller's, or importer's warranty.
- In the case of Goods covered by a warranty, information concerning the existence and content of the warranty and the time for which it is granted is presented each time in the description of the Goods on the Store's website.
XII. Out-of-Court Complaint Resolution and Redress for Consumers
- The Consumer has, among others, the following possibilities to use out-of-court complaint and claim resolution methods:
- is entitled to apply to the permanent amicable consumer court operating at the Trade Inspection with a request to resolve the dispute arising from the Sales Agreement,
- is entitled to address the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings concerning the amicable end of the dispute between the Consumer and the Seller,
- can obtain free assistance in resolving the dispute between the Consumer and the Seller, also using the free help of the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., Consumer Federation, Association of Polish Consumers). Advice is provided by the Consumer Federation under the free consumer hotline number 800 007 707 and by the Association of Polish Consumers at the email address porady@dlakonsumentow.pl.
XIII. Personal Data Protection
The personal data provided by the Users is collected and processed by the Seller in accordance with the applicable legal provisions and in accordance with the Privacy Policy, which constitutes Annex No. 2 to the Regulations.
XIV. Final Provisions
- Resolving any disputes arising between the Seller and the Consumer is subject to the courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure. Resolving any disputes arising between the Seller and the Entrepreneur is subject to the court competent due to the Seller's seat.
- In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on electronic service provision, the provisions of the Act on consumer rights, and other relevant provisions of Polish law shall apply.
- The content of these Regulations may be changed. Any changes will be informed to each Consumer through information on the Store's homepage containing a summary of changes and the date they come into effect. Consumers with an Account will be additionally informed about the changes with their summary at the email address provided by them. The effective date of the changes will not be shorter than 14 days from the date of their announcement. If a Consumer with an Account does not accept the new content of the Regulations, they are obliged to notify the Seller of this fact within 14 days from the date of being informed about the change of the Regulations. Failure to accept results in the termination of the agreement.
- Changes to the Regulations concerning Entrepreneurs come into effect on the day of its publication on the Store's website.
